I was notified of copyright violations last night. The copyright was based upon some of the nose art.
I am going back and scrubbing all of the older green nose art, and removing them from all posts. Please do not use the green noses as continued use could cause this board to be closed.

This raises the bigger question, what other imagery is copyrighted? Mission maps and graphics? Avatar images? Best not to use anything you didn't personally create from scratch.

Just caught this. Which "art" are we talking about? Should I do anything in the future I don't want to step on any toes. Also curious, can you not just compile a disclaimer that anything posted is for the sole interest of enjoying the game? I know a different game bboard I was on (football) someone tried to challenge the name of the site (Naflsim) because they were claiming ownership of "NAFL". The site commish just added a disclaimer that the site was a sports simulation using a certain application and no other associations or intentions were implied. Could you not also consider something similar by adding a disclaimer that all content is intended to support the immersion of it's members using QoTS and TfT in a WW2 simulation of the European and North African Air War.

Sitting here scratching my head. An artist claimed that the nose art used by a number of users on this site were his copyright protected images. ProBoards complied with his request that we remove those images. Personally, I looked at the images and thought that IF the art various members had used were based on original creations belonging to this artist, that those images on our site looked to have been manipulated enough to be considered transformed to the point that they were no longer the original images that may have been drawn by this artist. The only way to clarify something like that is in a court of law and I don't blame ProBoards for just taking the easy way out and telling us to remove all the images.

What I don't understand though Lou is the fact that this site is not profiting from the use of any graphic used. I could understand it if you had to "purchase" the use of it here or it was used in any other manner that and exchange of something of value was made for it but from what I have seen that is so far from the case it is unreal. Yes, at the end of the day if the "someone" does have it copyrighted but is that anal that they cannot see how it is being used (player immersion, etc.) then I feel sorry for them even though I would have to agree that it is overall safer to comply then challenge. So my question now then is much what crushed asked. Where is the line drawn? And if possible, can we know which art it was to ensure we stay away from it?

As a gamer and fan of the nose art I see the argument that it wasn't used for profit, and I can see the argument about modification. On the other hand, the original artist sells these images and if we really wanted them bad enough we'd be potential sales that e's otherwise not getting. So, even though we weren't making any money, we were potentially costing him. WE could have been up against the same problem with many of the images that were inserted into the nose image. Best just to rely solely on original work. And, since I'm not an artist, my posts are now sans visuals.

On a related vein, a few years back there was a big to do in the model RR community. Union Pacific was claiming Trademark infringement on all the manufacturers selling models decorated with the UP logo. While they eventually worked things out, for a while it looked like nobody was going to be able to model UP. To those who make a living on these things it's serious business.
